1) Scope of Application

1.1 These Terms and Conditions (GTC) of BG Investment GmbH (“Seller”) apply to all contracts between the Seller and a buyer (“Client”) regarding the goods and/or services presented in the Seller’s online shop. The inclusion of the Client’s own terms is expressly rejected unless otherwise agreed.

1.2 By using the Seller’s website, the Client agrees to be bound by these GTC.

1.3 The Seller reserves the right to modify these GTC at any time, with substantial changes being communicated at least 30 days in advance. Continued use of the Seller’s services constitutes agreement to the updated GTC.

1.4 The Client agrees to electronically access, sign, and authenticate documents as permitted under the E-SIGN Act, UETA, and applicable state laws. An electronic signature holds the same validity as a handwritten one.

2) Conclusion of the Contract

2.1 Product descriptions in the Seller’s online shop do not constitute binding offers but serve as invitations for the Client to submit a purchase offer.

2.2 The Client submits a binding offer by completing the online order process.

2.3 The Seller may accept the offer within five days by:

• Sending a written order confirmation (fax or email)

• Dispatching the ordered goods

• Requesting payment from the Client

2.4 The period for acceptance starts the day after the Client submits the offer and ends five days later. If the Seller does not accept within this period, the Client is no longer bound by their offer.

2.5 The contract details will be sent to the Client via email, fax, or letter post-purchase.

2.6 Clients can correct their order before final submission.

2.7 English is the exclusive language for contract formation.

3) Return Policy

We accept returns within 30 days of receipt. To initiate a return, contact us at support@firekitshome.com. If approved, we will provide a shipping label and instructions. Items returned without prior request will not be accepted.

Returns are not accepted for sale items or gift cards. Items must be unworn, in original packaging, with proof of purchase. Returns should be sent to:

For issues regarding defective or incorrect items, contact us immediately at support@firekitshome.com.

Refunds will be processed within 10 business days of return approval. If it takes longer than 15 business days, contact us at support@firekitshome.com.

4) Price and Delivery Costs

4.1 Prices are in USD, excluding taxes and shipping fees. Shipping costs are specified in product descriptions. If an incorrect price is displayed, the Seller will either honor the lower price or reject the order.

4.2 Additional fees, including customs duties and bank charges, may apply for U.S. deliveries.

4.3 Payment methods are listed in the Seller’s online shop.

5) Shipment and Delivery Conditions

5.1 Goods are shipped to the address provided by the Client.

5.2 If an item is unavailable, the Seller will notify the Client and offer an alternative product or refund. The Seller is not liable for unavailability.

5.3 If delivery is unsuccessful due to the Client’s fault, the Client will bear the return shipping costs.

6) Warranty

The Seller disclaims any implied warranties of merchantability or fitness for a particular purpose. Liability for indirect, special, or consequential damages is excluded. The Seller’s total liability is limited to the price paid by the Client for the specific product in question.

Certain jurisdictions may not allow implied warranty exclusions; in such cases, the exclusions will apply only to the extent permitted by law.

7) Limitation of Liability Regarding the Use of the Seller’s Online Shop

7.1 The online shop is provided “AS IS” without any guarantees of accuracy, uninterrupted access, or security.

7.2 The Seller is not liable for damages caused by viruses obtained from the website.

7.3 External website links are provided in good faith. The Seller is not responsible for their content or privacy policies.

7.4 Some jurisdictions may not allow certain limitations of liability; these will apply only to the extent permitted by law.

8) Limitation of Action

No claims related to this contract may be initiated more than 12 months after the issue was reasonably discoverable.

9) Governing Law

All disputes are governed by the laws of the State of Illinois, excluding the UN Convention on Contracts for the International Sale of Goods.

10) Designation of Forum

All legal actions must be brought in the state where the Seller operates. The parties consent to the exclusive jurisdiction of the courts in that state.
